Competition law in liner shipping

What cooperation between liner carriers may do, and where the line runs

The consortia block exemption expired on 25 April 2024 and was not renewed; liner cooperation has since been measured directly against Article 101 TFEU. The course draws the line between a permitted operational arrangement and a hardcore restriction, and shows how an agreement is now assessed in-house.

What you can do after the course

These are the learning objectives as defined for the course. The final test measures against them.

1

You place the consortia block exemption in time and state that it ended on 25 April 2024.

2

You distinguish permitted operational arrangements from hardcore restrictions, which were never covered by the exemption either.

3

You calculate the market share threshold and apply it as a test.

4

You assess a consortium agreement yourself against Article 101(1) and 101(3) TFEU as it has applied since 26 April 2024.
