13 Oct 2023 a South African mobile operatorFixed-term contracts: consumer tribunal fines South African mobile operator ZAR 1m South AfricaConsumer protection and online retailanonymised €50,096

On 13 October 2023, on application by the National Consumer Commission (NCC, South Africa's consumer protection authority), the National Consumer Tribunal (NCT, the consumer protection adjudicator) found, in proceedings confined to eleven consumer complaints, that a mobile operator had breached the Consumer Protection Act, including by charging unreasonable fees for early cancellation of fixed-term contracts, by requiring all outstanding amounts and the fee to be paid before a cancellation took effect, by implementing cancellations late and by failing to notify a customer that a contract was about to end; a data package that was not available had also been advertised and sold. The Tribunal regarded part of the conduct – such as continuing to bill after cancellation, together with the use of debt collectors and listings with credit bureaus – as unconscionable under section 40 and imposed an administrative fine of 1,000,000 ZAR.

What organisations can take from it

Cancellation fees and processes for fixed-term contracts should be reviewed regularly – consumer authorities pursue even bundled individual complaints through to a fine.
