31 Oct 2024 VAFO PRAHA, s.r.o.ÚOHS: CZK 120m fine for VAFO PRAHA over resale price maintenance for pet food CzechiaCartels and collusion €4.74m

The Czech competition authority ÚOHS (Office for the Protection of Competition) fined the pet food manufacturer VAFO PRAHA 120,121,000 CZK in a settlement procedure (narovnání). From January 2013 to September 2021 the company fixed minimum retail prices with 30 customers for dog and cat food of the Brit and Carnilove brands, monitored compliance and also responded to deviations with sanctions, infringing the Czech Competition Act and Article 101 TFEU; further implementation of such agreements was prohibited.

What organisations can take from it

Sales teams must never enforce or monitor recommended retail prices; an effective compliance programme reduces the fine but does not replace clean distribution practice.
