The Openbaar Ministerie (OM, Dutch Public Prosecution Service) settled proceedings against a Dutch yacht builder, not named in the release, with a penalty order of 150,000 EUR because in 2022 it sourced furniture and finishing wood made of Myanmar teak from a Turkish woodworking company and, as the first to place it on the EU market, did not meet the due diligence obligations of the EU Timber Regulation (EUTR); the legal origin of the wood could no longer be established. The yard was not at fault regarding the deck timber of the superyacht, because a German trader had placed that on the market; the information was passed to the German authorities. The OM took into account that the yard admitted the breach and no longer uses Myanmar teak.
Anyone importing timber products directly from non-EU countries becomes an operator with due diligence obligations and must be able to prove legal origin before buying.
