The nationwide wine and spirits distributor headquartered in Florida entered into a non-prosecution agreement and pays USD 12.5 million. It admitted that executives and employees had for years provided employees of alcohol retailers, including grocery chains in California, with cash, prepaid gift cards, flights, golf trips, resort stays and luxury goods to influence the purchase and placement of its products, concealing this through third-party vendors and false invoices. The authority allegedly made the findings set out here; this account is not based on a final judgment.

12 Aug 2026 Lab Pharma ASLab Pharma AS: NOK 205,000 for threatening Datatilsynet staff €18,745
Datatilsynet (Norwegian Data Protection Authority) fined the online dietary supplement retailer Lab Pharma AS NOK 205,000 for breaching its duty to cooperate with the supervisory authority (Art. 31 GDPR): the company had threatened case handlers with police reports and lawsuits in order to end the investigation of a complaint, and submitted requested documents late. The authority also ordered the company to delete the name and images of a former advertising partner (an influencer) from all its websites and to stop using her data for marketing until it can demonstrate a legal basis, as the underlying contract had already expired in March 2017.
Anyone who considers a supervisory order unlawful must use the available appeal routes – threats against case handlers and missed deadlines become a sanctionable breach in their own right.

6 Aug 2026 Brand Developers Limited (The TV Shop)The TV Shop: 1,104,000 NZD for manipulated online reviews and misleading claims €562,720
The company behind The TV Shop had its own staff post positive product reviews without disclosing the connection, and published one- to three-star reviews only if customers responded to a follow-up email. It also gave customers the impression that they had no rights under the Consumer Guarantees Act beyond a 30-day money-back guarantee, and advertised an accessory pack for the Air Roaster Pro as “free” although it was always included. After a guilty verdict on 13 charges, the District Court imposed 1,104,000 NZD on 6 August 2026; the company had already been fined in 2015 (153,000 NZD) and 2022 (123,500 NZD).

After liability was established in 2024 and upheld on appeal in 2025, the Court set penalties of AUD 35 million against Harvey Norman and AUD 20 million against Latitude and ordered corrective notices on the home pages for 90 days. It based the higher penalty for Harvey Norman on its lower level of contrition.

According to the US Department of Justice (DOJ), the company had employees cover up “Made in China” markings, concealed the origin from its customs broker and cancelled orders that were due to be inspected; the settlement of 7.3 million USD (a joint payment with a further settling party) resolves a whistleblower lawsuit.

24 Jun 2026 Kaufland Hrvatska k.d.Croatia: 300,000 EUR against Kaufland for unfair practices towards suppliers €300,000
The Agencija za zaštitu tržišnog natjecanja (Croatian Competition Agency, AZTN) found that Kaufland Hrvatska charged food suppliers fees for services not provided and for advertising not commissioned, and paid for perishable goods only after more than 30 days. For these unfair trading practices, and with repeat offending as an aggravating factor (final penalty already in 2020), it imposed 300,000 EUR (date = publication).
Purchasing departments must know the payment deadlines and fee prohibitions of UTP law – repeat offences become significantly more expensive.

23 Jun 2026 Deghi S.p.A.Deghi: 2 million EUR for endlessly renewing countdown discounts €2m
From January 2024 to December 2025, the online retailer advertised time-limited discounts with countdown timers which, once they had expired, restarted with a new timer on identical terms. The AGCM classified this artificial scarcity as a particularly insidious dark pattern and imposed a fine of 2 million EUR.
A countdown must genuinely expire – an automatically restarting timer creates misleading scarcity.

15 Jun 2026 Marks Electrical LimitedCMA: GBP 720,000 fine for Marks Electrical over pre-selected extra services €832,534
Using its new powers under the DMCCA 2024, the CMA found that the electrical retailer had pre-selected and charged customers on its website for paid extra services (removal of the old appliance, packaging disposal) without their express consent during the period examined, April to November 2025. It imposed a fine of GBP 720,000 (GBP 1,200,000 before a 40% settlement discount) and required the company to refund the amounts charged in this way to affected customers (around GBP 600,000 according to the CMA).
Paid add-ons must never be pre-selected in an online shop – since the DMCCA, the CMA can impose fines and order refunds itself.

A separate decision on the same day imposed a further 201,106,000,000 KRW for collecting behavioural data on third-party websites and apps without consent.
When employees leave, every key and credential they knew must be renewed immediately – otherwise a single signing key can open the entire customer account system.

Datatilsynet (Norwegian Data Protection Authority) fined Elkjøp Nordic AS and Elkjøp Norge AS NOK 20,000,000. Following an on-site inspection in June 2022, the authority found that consent for the customer club was neither informed nor specific nor freely given, that club data had been reused without a legal basis for the 'kundematch' (customer match) tool, that the lawfulness of so-called offline conversions had not been assessed and documented, and that rectification requests had not been handled within the deadlines. The decision was adopted under the cooperation mechanism with the supervisory authorities of Sweden, Iceland, Finland and Denmark; more than six million club members across the Nordic countries were affected.
Anyone who ties discounts to club membership must obtain separate, informed and freely given consent in advance for each marketing purpose and must not reuse club data for new purposes such as audience matching without assessment.

6 May 2026 HP TRONIC Zlín, spol. s r.o.HP TRONIC Zlín: 39 million CZK for price requirements imposed on electronics retailers €1.6m
For more than ten years from 2012, the distributor and retailer of consumer electronics and household appliances set minimum resale prices for its retail customers, monitored them and sanctioned deviations. The Úřad pro ochranu hospodářské soutěže (Czech Office for the Protection of Competition, ÚOHS) imposed 38.971 million CZK; a leniency application, settlement and an improved compliance programme reduced the fine, and the company appealed against the amount.
Reprimanding retailers over low prices risks high fines – an effective compliance programme can reduce them but is no substitute for ending the practice.

17 Apr 2026 Cream della Cream Switzerland GmbH und Philipp Plein International AGFDPIC ruling: Philipp Plein and Cream della Cream ignored objections to advertising Order
Both companies continued to use e-mail addresses and telephone numbers from online purchases for advertising, although data subjects had objected – in some cases after deletion had been confirmed. The Swiss Federal Data Protection and Information Commissioner (Eidgenössischer Datenschutz- und Öffentlichkeitsbeauftragter, EDÖB) ordered the processing for advertising to cease and the data to be deleted on request.
An objection to advertising must take effect across all systems – a confirmed deletion followed by further advertising violates the principle of good faith.

3 Apr 2026 LPP S.A.LPP: PLN 15m for flawed consolidated accounts after the outbreak of war in Ukraine €3.5m
The KNF imposed a fine of PLN 15,000,000 on the listed issuer LPP for breaches of disclosure obligations in its consolidated financial statements for 2021/2022 and 2022/2023. LPP had wrongly recognised impairments of PLN 608m on fixed assets and inventories resulting from the Russian attack on Ukraine of 24 February 2022 as an adjusting event in the 2021/2022 statements and did not correct the comparative figures in the following year, although the authority had repeatedly recommended this and the auditor had issued qualifications. The decision is not final.
Issuers should promptly act on supervisory recommendations and auditor qualifications on accounting treatment rather than carrying errors forward.

17 Mar 2026 Morellato S.p.A.AGCM fines Morellato €25.9m for online resale price maintenance and marketplace ban €25.9m
The AGCM found that, within its selective distribution system for jewellery and watches, Morellato set its retailers' online resale prices and prohibited them from using third-party marketplaces and intermediation platforms from 20 July 2018 to 23 December 2025; by way of retaliation, Morellato blocked orders (Art. 101(1) TFEU). The fine amounts to 25,895,043 EUR.
Manufacturers may not dictate retailers' online selling prices or impose blanket bans on platform sales, and using supply stops as leverage aggravates the infringement.

12 Mar 2026 Amazon Europe Core S.à r.l.Luxembourg: Cour administrative annuls 746 million EUR fine against Amazon but confirms infringements overturned
In 2021, the Luxembourg data protection authority (CNPD) had imposed 746 million EUR and an order to bring processing into compliance on account of behavioural online advertising; the Administrative Tribunal (Tribunal administratif) confirmed this on 18 March 2025. On 12 March 2026, the Administrative Court (Cour administrative) confirmed that legitimate interest was not a sound legal basis and that the information was insufficient, but annulled the fine on the basis of more recent CJEU case law on the requirement of culpability; the CNPD is re-examining the sanction.
Personalised advertising cannot be based on legitimate interest – and courts now scrutinise culpability closely when it comes to fines.

12 Feb 2026 Louis Vuitton BVOM: €500,000 penalty order for Louis Vuitton BV over inadequate customer checks €500,000
The Openbaar Ministerie (OM, Dutch Public Prosecution Service) imposed a penalty order of 500,000 EUR on the Dutch Louis Vuitton BV for breaches of the Wwft (Dutch Anti-Money Laundering and Anti-Terrorist Financing Act) because, over a long period, the company did not sufficiently check who the customers were who repeatedly spent large amounts in cash. The case arises from ongoing money laundering proceedings in which, according to the OM, a buyer spent a total of more than 2 million EUR of criminal proceeds under various names on luxury goods in shops such as those of Louis Vuitton between August 2021 and February 2023 and sent the bags to China for resale; a then sales employee allegedly helped her and warned her whenever she was about to spend more than 10,000 EUR a month through one of her customer accounts. The OM settled the matter out of court to free up scarce hearing capacity at the Rechtbank Rotterdam (Rotterdam District Court).

In a second consent decree, Lowe's Home Centers undertakes to pay a civil penalty of allegedly 12,500,000 USD and to introduce a company-wide programme so that the installation firms it hires work lead-safely in homes built before 1978. The EPA had found breaches of the Lead Renovation, Repair and Painting Rule on more than 250 renovation jobs in 23 states, mostly from 2019 to 2021, such as missing certified renovators, missing customer information and inadequate dust containment, as well as breaches of a 2014 settlement. The settlement was lodged with the court on 25 November 2025. The authority allegedly made the findings set out here; this account is not based on a final judgment. The decision is not final.

17 Nov 2025 H&M ABH&M: Consumer Ombudsman bans discount claims based on a wrong lowest prior price Order
The Konsumentombudsmannen (KO, Swedish Consumer Ombudsman) issued H&M with a prohibition order (föreläggande) because, when advertising price reductions, the company had stated a higher price than the lowest price applied in the previous 30 days, in breach of the Price Information Act (prisinformationslagen). The prohibition is backed by a conditional fine (vite) of 2,000,000 SEK; KO reduced it from 3 million SEK because the breach was limited and H&M had taken countermeasures. An earlier supervisory case from 2023 on long sale periods had been closed in March 2024 after the company stated, among other things, that it was working continuously to comply with the rules.
Strike-through prices and discount claims must refer to the actual lowest price of the last 30 days; pricing systems should check this automatically.

18 Sep 2025 Samaritaine SASCNIL: €100,000 fine for Samaritaine over hidden cameras in stockrooms €100,000
The CNIL (French data protection authority) fined Samaritaine SAS, operator of the Paris department store of the same name, EUR 100,000 because in August 2023, in response to thefts of goods, it had installed cameras disguised as smoke detectors and capable of recording sound in two stockrooms, which employees discovered a few weeks later. The CNIL objected to the lack of any prior assessment and documentation of the covert deployment, intended to be only temporary, the excessive recording of employees' conversations, the late involvement of the data protection officer, and the failure to notify and document a personal data breach after employees kept the memory cards containing the recordings when the cameras were removed (Art. 33(1) and (5) GDPR).
Covert cameras aimed at employees are permissible only exceptionally, for a limited period, documented and after involving the data protection officer; sound recording is generally disproportionate.

12 Sep 2025 Japanet Takata Co., Ltd. (株式会社ジャパネットたかた)Japanet Takata: order over comparison with a future 'regular price' for osechi Order
From 8 October to 23 November 2024, Japanet Takata offered a two-tier New Year food box ('osechi' for 2025) in its online shop, stating that the 'Japanet regular price' of 29,980 JPY had been reduced by 10,000 JPY to 19,980 JPY, with the regular price presented as applying after the promotion ended. There was no reliable plan to sell at the higher price afterwards; the investigation was conducted jointly with the Kyushu office of the Japan Fair Trade Commission (JFTC, 公正取引委員会).
Anyone advertising against a future price needs a robust sales plan at that price that is actually carried out.

2 Sep 2025 IDdesign A/SIDdesign: High Court raises GDPR fine to 1.5 million DKK – group turnover counts €200,986
The furniture retailer had stored data of around 385,000 customers in a legacy system without retention periods. The district court had imposed 100,000 DKK; following a referral to the CJEU on whether the fine is to be calculated on the basis of the turnover of the entire group, the High Court increased the fine to 1.5 million DKK.
Retention periods also apply to legacy systems in individual branches – and the group turnover counts when setting the fine.

26 Aug 2025 Kmart Australia LimitedKmart: facial recognition used against refund fraud breached the Privacy Act Order
From June 2020 to July 2022, Kmart Australia used facial recognition in 28 stores to record the face of every person who came in and of every customer at the returns counters, with the aim of uncovering refund fraud, without informing them or obtaining their consent. The Privacy Commissioner rejected the exception for addressing unlawful activity, because the indiscriminate collection of sensitive biometric information was disproportionate given less intrusive alternatives and its limited benefit, and ordered that the conduct must not be continued or repeated. The decision is currently under review before the Administrative Review Tribunal; hearings are scheduled for early 2027. The decision is not final.
Before deploying facial recognition, organisations must assess and document whether less intrusive means would suffice and whether the intrusion into the privacy of everyone captured is proportionate.

21 Aug 2025 Kwong's Art Jewellery Trading Company Limited, My Jewelry Management LimitedJewellery companies: data of around 79,400 people stolen – enforcement notices Order
At Kwong's Art Jewellery Trading Company Limited and its retail subsidiary My Jewelry Management Limited, which run their IT systems jointly, an attacker (reported in November 2024) obtained the credentials of an administrator account by brute force, exfiltrated the database and deleted it; around 79,400 individuals were affected, including customers and current and former employees. In its report published on 21 August 2025 the PCPD (Privacy Commissioner for Personal Data, Hong Kong's data protection authority) found breaches of DPP 4(1), among other things because the account of a departed employee had not been deleted in time, server operating systems were outdated and security policies and security assessments were lacking. Both companies were served enforcement notices to remedy the deficiencies and prevent further contraventions.
Delete the accounts of departing staff immediately, keep servers up to date and protect administrator access against brute-force attacks.

4 Aug 2025 Infinite Styles Services Co. Ltd (Shein)AGCM: 1 million EUR fine against Shein for misleading environmental claims €1m
Italy's competition and consumer protection authority (Autorità Garante della Concorrenza e del Mercato, AGCM) objected to vague and in part false claims about circular design and recyclability, about the ‘green’ evoluSHEIN collection (only a small share of the range) and about emission targets, while emissions rose in 2023/2024. The ultra-fast-fashion model is subject to a heightened duty of care, the authority held; it imposed 1 million EUR (case PS12709).

30 Jul 2025 Kmart NZ Holdings LimitedKmart NZ warned over unsubstantiated “100% sustainably sourced cotton” claim Reprimand or warning
The Commerce Commission (ComCom, New Zealand's competition and consumer regulator) warned Kmart NZ Holdings Limited because, from 4 August 2023 to 4 October 2024, the company advertised own-brand clothing with the claim “100% sustainably sourced cotton” without being able to substantiate it: the cotton sourced as “Better Cotton” was mixed with conventional cotton in the supply chain. The authority considers a breach of s 12A Fair Trading Act 1986 (unsubstantiated representations) likely; only a court could determine one.
Absolute environmental claims such as “100%” require complete proof across the supply chain; a sustainability scheme whose raw material is mixed with conventional material does not support them.

The Agencija za zaštitu tržišnog natjecanja (AZTN, Croatian Competition Agency) found that the retail chain TOMMY d.o.o. sold twelve food products to consumers on 4 October 2023 below their purchase price including VAT by combining a promotional price with a 10 % customer discount, which the law against unfair trading practices in the food supply chain prohibits. The authority stressed that discounts as such are permitted and, taking several mitigating circumstances into account, imposed 212,500 EUR.

8 Jul 2025 Markant Handels- und Industriewaren-Vermittlungs AG und 16 Händlerinnen (in der Quelle nicht namentlich genannt)WEKO fines 16 retailers in the Markant buying cooperation around CHF 28 million €29.9m
The Wettbewerbskommission (WEKO, Swiss Competition Commission) found discounts negotiated jointly through the Markant cooperation to be lawful, but not opaque rebates: suppliers had to buy an ever more expensive service package from Markant, part of whose fees Markant passed on undisclosed to 16 retailers, and suppliers who refused faced collective countermeasures up to delisting. WEKO classed this as an unlawful purchasing-side price agreement and fined the 16 retailers a total of around CHF 28 million. The decision can be appealed to the Federal Administrative Court.

20 Jun 2025 Goldheart Jewelry Pte. Ltd.Goldheart Jewelry: 58,000 SGD over security patch applied eleven months late €39,197
The jeweller applied a patch released in February 2022 for a known vulnerability (CVE-2022-24086) in the Magento platform of its online shop only in January 2023; through the gap an attacker extracted the customer database with data on 41,379 individuals and posted it on an online forum in May 2023. The Personal Data Protection Commission (PDPC, Singapore's data protection authority) found a negligent breach of the Protection Obligation because the company relied entirely on its maintenance vendor for patching without directing or monitoring it, and rejected the argument that the vendor had been a data intermediary. Alongside 58,000 SGD (provisionally 64,000 SGD; the finding on credentials stored in plain text was dropped after representations) it directed an external security audit of access controls and the remediation of any gaps.

30 May 2025 Adidas America Inc.Adidas America: USD 235,000 OSHA settlement over persisting fall hazards €207,249
Adidas America reached a settlement with the US Department of Labor for penalties of 235,000 USD after OSHA, during a 2024 follow-up inspection at a warehouse in New York State, found the missing guardrails and unsafe ladder already cited in 2021 still uncorrected and identified a further unsafe ladder. The company must introduce a safety and health management programme at sites in New York, New Jersey and Puerto Rico, retrain employees on fall hazards, assess fall risks at each site and stop using overhead storage areas. The authority allegedly made the findings set out here; this account is not based on a final judgment.
Cited deficiencies must be demonstrably corrected – if a follow-up inspection finds the same issues, the case becomes considerably more expensive.

20 May 2025 13859380 Canada Inc. (Crane Supply)Crane Supply: CAI limits AI-enabled driver cameras in delivery vehicles Order
In 2023 the wholesale distributor of pipes and valves installed a camera system in all its delivery vehicles that also films the driver's cab from engine start until 20 minutes after the engine is switched off and uses artificial intelligence to detect events such as phone use, not wearing a seatbelt or smoking. The Commission d'accès à l'information (CAI, Quebec's access to information and privacy commission) found the necessity of the collection not established because the intrusion into drivers' privacy had not been sufficiently minimised, and ordered the company to limit in-cab recording to a few seconds before and after an incident or to stop it, to stop recording once the engine is off and to destroy any recordings going beyond that.
Cameras in company vehicles should only record around specific events; continuous recording of drivers is hard to justify.

Following a preliminary investigation into rising food prices, the Комисия за защита на конкуренцията (Bulgarian Commission for the Protection of Competition, KZK) found that Kaufland had demanded and received payments from five suppliers for ‘marketing services’ and for ‘optimisation of goods flows’ and logistics that were not fully connected with the sale of their products. For the two prohibited trading practices (Art. 37b(1)(4) ZZK – Bulgarian Protection of Competition Act) it imposed 250,000 leva each, a total of 500,000 leva. 8 May 2025 Musinsa Co., Ltd., Shinsung Tongsang Co., Ltd., E-Land World Co., Ltd., ITX Korea Co., Ltd.Greenwashing on leather products: KFTC warns four fashion chains, including ZARA operator Reprimand or warning
The KFTC (Korea Fair Trade Commission, Korea's competition and consumer authority) found that Musinsa, Shinsung Tongsang, E-Land World and ITX Korea (operator of ZARA in Korea) had advertised leather products, including those made of synthetic materials, with blanket environmental terms such as 'eco' without sufficient evidence, and treated this as false, exaggerated and misleading advertising under the Labeling and Advertising Act. Because all four admitted the violations and corrected them voluntarily, it limited itself to warnings, issued between 2 April and 8 May 2025 (Shinsung Tongsang 2 April, Musinsa 10 April, E-Land World and ITX Korea 8 May); according to the KFTC it was the first sanctioned greenwashing case in the fashion sector.
Environmental claims such as 'eco' need a specific, substantiated reference to the whole product, otherwise they count as misleading.

7 May 2025 Sennheiser electronic SE & Co. KG, Sonova Consumer Hearing Sales Germany GmbHBundeskartellamt: fines against Sennheiser and Sonova over resale price maintenance Fine
Since at least 2015, Sennheiser coordinated consumer prices for premium headphones with dealers, monitored them using price comparison services and specialist software and intervened when prices were too low; Sonova continued this after acquiring the business unit in March 2022 until September 2022. The employees had received competition law training but used this knowledge to conceal their conduct (code language). In a settlement procedure, the Bundeskartellamt imposed fines on both companies; the decisions are final.
Price monitoring software is no licence: anyone who responds to deviations by putting pressure on dealers is engaging in prohibited resale price maintenance.

25 Mar 2025 Adidas (Sportartikelhersteller)Nuremberg-Fürth Regional Court: Adidas may not claim 'climate neutral by 2050' without explanation Other
On an action by a consumer association, the Landgericht Nürnberg-Fürth (Nuremberg-Fürth Regional Court) ordered Adidas to cease the former statement 'By 2050 we will be climate neutral' on its corporate website and to reimburse warning costs. The statement created the impression that the goal would be reached solely through the company's own emission reductions, although green electricity certificates were also to be used; a reference only in the linked annual report was not sufficient. According to the court's press release of 26 March 2025, the judgment was not final; whether an appeal was lodged is not known here.

18 Feb 2025 Metro Inc.Metro: CAI bans facial recognition database against shoplifting Order
In 2024 Metro notified the Commission d'accès à l'information (CAI, Quebec's access to information and privacy commission) of a pilot project in which people entering stores of the Metro, Super C and Jean Coutu banners would be matched by facial recognition, using the cameras at entrances and exits, against a biometric database; the database was to hold people involved in shoplifting or fraud incidents that led to police intervention. The CAI treated this as identity verification by means of biometric characteristics, which under s. 44 of the LCCJTI (Quebec Act to establish a legal framework for information technology) requires the express consent of the persons concerned, and prohibited putting the database into service. The decision is being challenged before the Court of Québec. The decision is not final.

28 Jan 2025 OGH raises gun-jumping fine against food retailer from 1.5 to 70 million EUR €70m
A food retail group anonymised in the decision (R*) had, through its subsidiary, implemented a notifiable concentration without merger control clearance by means of a long-term lease of store space in a shopping centre (1 July 2018 to 20 September 2022). The Cartel Court (Kartellgericht) imposed a fine of 1.5 million EUR; Austria's Supreme Court (Oberster Gerichtshof, OGH) upheld the appeals of the Federal Competition Authority (Bundeswettbewerbsbehörde, BWB) and the Federal Cartel Prosecutor (Bundeskartellanwalt) and set the fine at 70 million EUR, taking into account the group turnover of 92.3 billion EUR and an earlier fine for prohibited implementation.
Taking over stores by way of a lease or tenancy agreement can also be a notifiable concentration – expansion departments must check merger control requirements.

24 Jan 2025 Fantasia Trading LLC, Power Mobile Life LLC und Smart Innovation, LLC (Vertrieb der Marke eufy)eufy cameras: 450,000 USD in New York over unencrypted video streams Fine
The New York Attorney General's office concluded an Assurance of Discontinuance with three US distribution companies of the eufy home security brand. Contrary to advertising promising privacy and end-to-end encryption, the cameras' video transmissions were in part not end-to-end encrypted and in part not encrypted at all, a live video stream could in some cases be accessed without authentication via the relevant URL, and testing processes that could have detected these vulnerabilities were lacking. The companies allegedly pay 450,000 USD in penalties and costs and must regularly substantiate that the manufacturer maintains an information security programme, secure software development, vulnerability management with penetration testing and encryption of the videos.
A company that advertises encryption and privacy must be able to back this up with regular security testing – even as a distributor of a manufacturer's products.

New York aviation products supplier SkyGeek Logistics, Inc. is paying USD 22,172 under a settlement with OFAC for six apparent violations of the Russia sanctions. According to OFAC's findings, between January and March 2024 the company sent four shipments worth USD 3,429.76 to two UAE-based companies and attempted two refunds totalling USD 17,511.63, although both had previously been added to the SDN List for their role in Russia's aerospace and technology sectors. Customers were initially not rescreened before refunds. OFAC treated the apparent violations as non-egregious and four of the six transactions as voluntarily self-disclosed; the base penalties totalled USD 27,715. 19 Dec 2024 Amazon.com Services LLCAmazon: company-wide OSHA settlement on ergonomics in logistics centres, USD 145,000 €139,490
OSHA and Amazon.com Services entered into a company-wide settlement resolving ten cases over ergonomic hazards – such as lower back and other musculoskeletal disorders – arising from inspections at ten facilities since summer 2022, which were due to be tried before the Occupational Safety and Health Review Commission in 2025. Amazon will pay 145,000 USD, according to OSHA more than 90 per cent of the penalties assessed, and must assess ergonomic risks annually at fulfilment, sortation and delivery centres, evaluate and implement controls and resolve employee complaints through a dispute resolution process. The authority allegedly made the findings set out here; this account is not based on a final judgment.
Ergonomic risks in warehouse logistics are now pursued like conventional safety failings – with a duty to assess risks across all sites.

12 Sep 2024 a Croatian retail chainCroatia: EUR 132,000 fine on a retail chain over unfair practices towards suppliers €132,000
The Croatian Competition Agency (AZTN) found that a Croatian retail chain, exploiting significant bargaining power, applied unfair trading practices to three food suppliers: prices were not agreed in writing before delivery, catalogue advertising was charged without clearly agreed prices and discounts, goods were returned for slow sales without a clear contractual basis and payment periods of 30 and 60 days were exceeded. Taking several mitigating circumstances into account, it set the fine at EUR 132,000.

21 Aug 2024 three Norwegian grocery chainsThree Norwegian grocery chains: NOK 4.93bn over price-hunter collaboration €421.7m
Konkurransetilsynet (Norwegian Competition Authority) fined Norway's three largest grocery chains a total of NOK 4,926,981,000: the first chain NOK 2,313,418,000, the second NOK 1,321,024,000, and the third chain and its parent company jointly and severally NOK 1,292,539,000. From January 2011 until at least April 2018, the chains had granted each other's price collectors ('prisjegere') extensive access to their stores, which increased price transparency between the competitors and weakened price competition; the authority also ordered the collaboration to end. The Konkurranseklagenemnda (Competition Appeals Tribunal) upheld the decision on 21 August 2025; according to the courts' official hearing list, Gulating lagmannsrett (Gulating Court of Appeal) will hear an action by the second chain challenging the validity of that ruling from 12 October 2026. The decision is not final.
Even seemingly harmless industry arrangements, such as mutual access for price collection, can amount to an anticompetitive exchange of information and trigger fines running into billions.

When customers bought alcoholic drinks, the supermarket chain had their date of birth recorded at the till from their identity document or on request, although a look at the identity document would have sufficed for the statutory age check; the NAIH (Nemzeti Adatvédelmi és Információszabadság Hatóság, Hungarian data protection authority) found breaches of, among other things, data minimisation, lawfulness and transparency. The Budapest-Capital Regional Court (Fővárosi Törvényszék) upheld these breaches but held that keeping the data in the till log files for 180 days did not amount to processing, and set aside the original fine of HUF 95m; in the repeated proceedings the NAIH set the fine at HUF 80,000,000 and ordered publication on the company's home page.
Where the law only requires an age check, a look at the identity document is enough; entering identity data into the till system in addition is not necessary.

In April 2024, the Office for Product Safety and Standards (OPSS) seized furniture from several product ranges because the purchasing company, as operator, could not demonstrate due diligence that sufficiently mitigated the risk of illegal timber. Following a second notice dated 30 May 2024, the company had to donate the goods to a named charity.
Even large retailers with their own sustainability programmes must be able to prove due diligence for each product and consignment – otherwise the goods may be seized.

2 May 2024 a Dutch online retailerACM: €163,000 fine for an online retailer over fake discounts €163,000
On its website, the online retailer repeatedly advertised discounts whose reference prices did not match the lowest price of the last 30 days and artificially raised its original prices, so that consumers assumed larger savings than actually existed. The ACM (Autoriteit Consument & Markt, Dutch competition and consumer authority) imposed a fine of 163,000 EUR and rejected the objection on 29 August 2024; on 11 November 2025 the Rechtbank Rotterdam (Rotterdam District Court) upheld the fine, and the ruling is final.

On a complaint by the Department of Justice, the federal court entered an agreed order with a civil penalty of 3,175,387 USD, the highest to date in a "Made in USA" case, and annual compliance certifications for five years.
A company already under an order needs sign-off for every origin claim in its range, otherwise a civil penalty follows.

18 Apr 2024 a Swedish fashion retailerSwedish fashion retailer: SEK 300,000 after covert camera surveillance by a team leader €25,780
The Integritetsskyddsmyndigheten (IMY, Swedish data protection authority) fined the fashion retailer 300,000 SEK over camera surveillance at its premises (distribution centre and warehouse). A team leader had operated a covert camera in a work room on his or her own initiative on a total of five nights; IMY attributed this to the company as controller because operational problems prompted it, the company's equipment was used and the footage was used in employment-related meetings. For the regular surveillance, IMY ordered the company to add the data protection officer's contact details to the signs.
Companies are liable for unauthorised, work-related surveillance carried out by managers; policies alone do not protect them, they have to reach the managers.

From 13 October 2011 to 23 March 2022, the French distribution subsidiary of a luxury watchmaker prohibited the authorised dealers in its selective distribution system from selling the brand's watches via the internet. The Autorité de la concurrence (French Competition Authority) rejected the justification based on combating counterfeiting and parallel trade, because all the competitors examined allowed their authorised dealers to sell online and that aim could be achieved by less restrictive means, and imposed EUR 91,600,000 jointly with the group's holding company, the foundation at the top of the group and a further group company. It did not consider the allegation of resale price maintenance to be proven.
A blanket online sales ban in selective distribution is a hardcore restriction that can hardly be justified by brand protection.

According to the U.S. Federal Trade Commission (FTC), the pharmacy chain used AI facial recognition in hundreds of stores from 2012 to 2020, which falsely flagged customers – particularly women and people of colour – as shoplifters; accuracy was neither tested in advance nor monitored, and employees were not adequately trained. Under the proposed settlement order (subject to approval by the bankruptcy court and the federal court), the chain may not use the technology for surveillance for five years and must delete images and algorithms developed from them; in addition, the FTC alleges a violation of its 2010 data security order.
AI systems with consequences for people need testing for error rates, ongoing monitoring and trained staff who critically review matches.

8 Dec 2023 a Polish retail chainPolish retail chain: PLN 87.2m for logistics fees charged to food suppliers €20.1m
The retail chain charged suppliers of agricultural and food products fees for moving goods from its central warehouses to its own stores, although this activity is part of the retail chain's own business and not a service to suppliers. UOKiK classed this as unfair use of contractual advantage, prohibited the practice and imposed a fine of PLN 87,232,571.40. The decision is not final.
Retail chains must not charge suppliers for activities that belong to their own operations, such as internal deliveries to their stores.

22 Sep 2023 a German outdoor retailerHamburg: order to record working time against outdoor retailer upheld by court Order
Following an anonymous complaint about Sunday work and overlong working days, the Hamburg Amt für Arbeitsschutz (Office for Occupational Safety) ordered one of Europe's largest outdoor retailers on 22 September 2023 to record the actual working hours of all employees, including those on trust-based working time, with start, end and duration, and to submit records. On 21 August 2024 the Verwaltungsgericht Hamburg (Hamburg Administrative Court) largely dismissed the action, finding § 22(3) sentence 1 no. 1 ArbSchG (German Occupational Safety and Health Act) a sufficient legal basis; only part of one item had become moot.
Trust-based working time does not exempt from time recording; occupational safety authorities can enforce it by order without waiting for new legislation.

30 Aug 2023 a Finnish furniture retailerFinnish furniture retailer: EUR 300,000 for misleading constant discounts on sofas €300,000
At the request of the Kuluttaja-asiamies (Consumer Ombudsman, Finland), the Markkinaoikeus (Market Court) imposed a penalty payment of 300,000 EUR on the furniture retailer. From July 2020 to October 2021, ten examined sofa models had been offered at reduced prices considerably more often than at their 'normal price', so that the references to the normal price misled consumers about the actual price advantage. It was the Consumer Ombudsman's first application for a penalty payment (1 million EUR had been sought); the Korkein hallinto-oikeus (Supreme Administrative Court) dismissed the appeals of both sides in 2024.
A discount is only genuine if the reference price was actually charged over a relevant period.

11 Aug 2023 a UAE branch of a luxury fashion retailerADGM: 13,500 USD fine for luxury fashion retailer over late goAML registration of a store €12,268
The FSRA (Financial Services Regulatory Authority, the financial regulator of Abu Dhabi Global Market, ADGM) fined the branch of the fashion retailer, registered as a dealer subject to anti-money laundering duties (DNFBP), 13,500 USD in respect of its store trading under the main brand, because despite reminders since May 2019 it only completed its registration on the goAML reporting system for suspicious transaction reports after a Warning Notice in May 2023 and did not respond to the regulator's correspondence. Without the 10% discount for late settlement the fine would have been 15,000 USD; on the same day an identical Final Notice, also for 13,500 USD, was issued to the same company in respect of its store trading under another of the group's brands.
Retailers of high-value goods are also subject to anti-money laundering duties and must set up their reporting channel before a suspicious case arises.

31 Jul 2023 an English football club and its parent companiesCMA: GBP 880,000 fine for football club over arrangement with sportswear retailer €1.03m
The CMA found that the club and a sportswear retailer agreed that the retailer would largely stop selling club clothing online in the 2018/19 season and, from the 2019/20 season until at least January 2021, would charge delivery on online orders of these items instead of offering its usual free delivery. Under settlement, a fine of GBP 880,000 was imposed on the club and its parent companies; the retailer had reported the arrangement and was not fined.
Agreements between a licensor and a retailer on sales channels or delivery terms are unlawful market sharing – distribution partnerships need a competition law review.

26 Jul 2023 a German drugstore chainKarlsruhe court bans drugstore chain's 'climate/environmentally neutral' claims Order
On an action by Deutsche Umwelthilfe, the Landgericht Karlsruhe (Karlsruhe Regional Court) ordered a German drugstore chain to stop advertising liquid soap, sun lotion and shower cream on the packaging as 'climate neutral' and a washing-up liquid as an 'environmentally neutral product'. In the court's view, the packaging of two of the products lacked essential information on the term; moreover, CO2 offsetting via, among other things, a time-limited forest protection project could in principle not deliver the promised lasting climate neutrality.
Anyone advertising climate neutrality through offsetting must explain on the packaging itself what is offset and must not promise a permanent effect that time-limited projects cannot deliver.
