The Banca d'Italia (Bank of Italy) imposed a fine of 480,000 EUR on Banco di Desio e della Brianza S.p.A. under Art. 144 of the Consolidated Banking Act (TUB). An inspection from 2 October to 15 December 2023 found shortcomings in organisation and controls for compliance with the rules on transparency and fair treatment of customers, including Arts. 117-bis, 126-septies and 126-quinquiesdecies et seq. TUB; the bank's corrective measures were taken into account.

What organisations can take from it

Transparency duties towards customers need their own controls within the organisation; where these are missing, the supervisor sanctions the bank even if individual errors are corrected later.
