Kalibrate's "Market Intelligence" product passed on retailer-specific sales data from petrol stations that allowed conclusions to be drawn about competitors and could facilitate coordinated pricing behaviour. Providers of market and price data must ensure that their products do not disseminate individualised competitor data.

16 Sep 2026 ENECHANGE株式会社ENECHANGE: 91.495 million JPY over overstated revenue in quarterly report and prospectus €511,488
Because revenue had been overstated at the company and its consolidated subsidiary or subsidiaries, the quarterly report for the third quarter of 2023 (filed on 10 November 2023) showed a consolidated loss of 1,382,861 thousand JPY instead of 1,662,516 thousand JPY; the registration statement for a share issue relied on this report, and on 26 February 2024 3,784,200 shares were issued for 3,999,899,400 JPY. After the company admitted the facts and the amount, an administrative monetary penalty (kachōkin) of 91,495,000 JPY was imposed: 1,500,000 JPY for the quarterly report and 89,995,000 JPY for the registration statement.
Revenue recognition at subsidiaries should be scrutinised before any capital increase; an error in a quarterly report becomes many times more expensive through the prospectus.

In an action brought by Notre Affaire à Tous, Sherpa, ZEA, France Nature Environnement and the City of Paris, the Paris Judicial Court (Tribunal judiciaire de Paris, 34th chamber) ruled that climate risks fall under the French duty of vigilance law and that Scope 3 emissions are part of the oil and gas group's activities. 18 May 2026 Adani Enterprises LimitedAdani Enterprises pays 275 million USD over Iranian liquefied petroleum gas €236.1m
From November 2023 to June 2025, the Indian conglomerate bought allegedly Omani and Iraqi liquefied petroleum gas (LPG) via a trader in Dubai which in fact originated from Iran; 32 payments totalling around 192 million USD were routed through US banks. The US Treasury's Office of Foreign Assets Control (OFAC) assessed the violations as egregious and not voluntarily self-disclosed; Adani had recklessly ignored numerous warning signs (AIS manipulation by the tankers, implausible loading ports, conspicuous price discounts, irregularities in the certificates of origin).
Companies that source commodities below market price via intermediaries must actively check origin, vessel movements and documents – mere name screening against sanctions lists is not enough.

The CADE Tribunal convicted three petrol station companies because in 2017 they had divided the lots of municipal fuel tenders in Coronel Vivida (Paraná) among themselves in advance and had also coordinated retail pump prices. The fines on the companies initially totalled 43,953,905.42 BRL (Comércio de Combustíveis Stang 25,801,726.15; a further petrol station company 9,406,784.68; Pato Comércio de Combustíveis 8,745,394.59 BRL). On motions for clarification (embargos) the Tribunal reduced, on 1 July 2026, the fines on Stang to 4,615,849.76 BRL and on Pato to 1,090,682.28 BRL owing to a subsequently arising fact relevant to the calculation, leaving 15,113,316.72 BRL. The amount and the facts have not been confirmed against the primary source.
Dividing lots in public tenders is a cartel infringement carrying heavy fines, even in small municipal procurement.

12 May 2026 Société Wallonne des Eaux (SWDE)SWDE: 86,000 EUR for call recordings without sufficient transparency €86,000
The Walloon water utility recorded and listened in on customer calls for quality control and training purposes; the Litigation Chamber of the Autorité de protection des données (Belgian Data Protection Authority, APD/GBA) found infringements of transparency and fairness as well as in the engagement of a sub-processor. It imposed two fines totalling 86,000 EUR (85,000 + 1,000) after reducing the amounts in view of the situation of the public utility; an appeal against the decision has been lodged with the Market Court.

7 May 2026 South Staffordshire Plc und South Staffordshire Water PlcICO: almost £1 million against water supplier South Staffordshire after cyber attack €1.12m
In 2020, malware entered the water supplier's network via a phishing e-mail and remained undetected for around 20 months; in 2022, attackers obtained administrator rights and stole data on 633,887 people, which ended up on the dark web. The UK Information Commissioner's Office (ICO) criticised, among other things, monitoring of only 5% of the IT environment, outdated software such as Windows Server 2003 and a lack of vulnerability and patch management.
Utilities in critical infrastructure must also monitor their entire IT estate and replace legacy systems – an attack must not only come to light through performance problems.

18 Mar 2026 Nova Scotia PowerNova Scotia Power: commitments to the Privacy Commissioner after ransomware attack Other
Following a cyber attack in spring 2025 in which data of about 375,000 current and 540,000 former customers was exfiltrated, including bank account, driver's licence and social insurance numbers, Nova Scotia Power signed a compliance letter to the Privacy Commissioner of Canada. The company commits to delete customers' social insurance numbers and, by 31 October 2026, to submit an independent security assessment – including employee training and notification processes – and to report on implementing its recommendations; only then will the investigation be discontinued. According to the letter, the starting point was an employee clicking a link in a pop-up on a compromised website, which installed malware.
A single click on a fake pop-up can expose hundreds of thousands of customer records – training, limited admin rights and prompt notification belong together.

3 Mar 2026 Killer GmbH & Co KG, Killer GmbHWaste cartel: €278,000 fine on waste firm Killer despite leniency status €278,000
The Kartellgericht (Cartel Court) fined Killer GmbH & Co KG and Killer GmbH allegedly 278,000 EUR for taking part in the nationwide waste management cartel from July 2002 to March 2021, mainly in Lower and Upper Austria and occasionally in Tyrol. The participants fixed prices, shared territories and customers and exchanged competitively sensitive information, including in tenders for waste collection. The fine was reduced because of leniency status and the consensual termination of the proceedings.
A leniency application made only after a dawn raid can reduce a fine but will not necessarily waive it; companies should investigate suspicions internally at an early stage.

Between October 2018 and August 2019, untreated sewage entered a brook in Pools Brook Country Park on three occasions – due to a burst rising main, a blockage caused by wet wipes and a failing pipe coupling; during the first incident, fish died in the park lake. Yorkshire Water had already pleaded guilty in January 2024 and had not attended any of the interviews; the court imposed a fine of 733,333 GBP plus costs. According to the annual accounts filed with the UK companies register for financial year 2026, the company had around 4,481 employees.
After a first incident, the cause at the site must be remedied permanently; repeated discharges from the same pipe lead to high fines.

The underlying offence was a breach of a permit condition: an inadequately maintained oil pipe at the Wytch Farm site had corroded, and on 23 March 2023 crude oil or reservoir fluid escaped into Ower Bay in Poole Harbour. According to the agency, the overall package amounts to around £6.1m, including response and clean-up costs and £620,000 paid to affected parties.

22 Dec 2025 Curenergía Comercializador de Último Recurso, S.A.U.AEPD: 500,000 EUR against energy supplier Curenergía after misdirected message in dual chat €500,000
An employee of the customer service provider was serving two customers in chat at the same time and assigned one customer's e-mail address to the other; as a result, the complainant received the name, debts and billing data of a stranger. The Spanish data protection authority (Agencia Española de Protección de Datos, AEPD) saw the cause in the process design, which allowed parallel chats, and imposed 500,000 EUR for lack of data protection by design; the request for reconsideration was rejected.

The Bundesnetzagentur (Federal Network Agency) imposed fines totalling 100,500 EUR on a solar photovoltaic company: 66,000 EUR for unlawful telephone advertising and 34,500 EUR for withholding caller numbers on sales calls. Callers concealed who the calls were really for and in some cases falsely presented sales calls as mere advisory calls.
Even a business that merely commissions sales calls can itself be fined – consent of the people called should be checked before a campaign starts.

In the reopened proceedings, the Javna agencija Republike Slovenije za varstvo konkurence (Slovenian Competition Protection Agency, AVK) found that the companies had shared the market for take-back schemes for packaging waste and agreed to stop providing their services to a competitor (now Interzero). The authority ordered immediate termination; the decision is not final, and an earlier decision from 2019 in the same matter is partly final.
An agreement to stop supplying a common competitor is a cartel – even in regulated waste management markets.

Shell UK pleaded guilty to two charges under the offshore fire and explosion regulations (PFEER 1995) and was fined £560,000. On 19 May 2017, around 200 kg of gas and 1,550 kg of crude oil escaped into a concrete leg of the Brent Charlie platform from corroded pipework that had originally been installed only temporarily; the ventilation systems had also been inadequately maintained. More than 170 people on board were exposed to a potential fire and explosion risk.
Temporary installations need a fixed removal date and, until then, their own inspection regime.

Applying Section 32f(2) of the German Competition Act (GWB) for the first time, the Bundeskartellamt (Federal Cartel Office) required Rethmann SE & Co. KG and its affiliated companies (the Rethmann Group, which includes Remondis) to notify for three years before completion even mergers below the general turnover thresholds, where the target generates more than 1 million EUR in domestic turnover and at least 100,000 EUR in the collection of non-hazardous municipal waste or the processing of hollow glass. The decision builds on the findings of the sector inquiry into municipal waste completed at the end of 2023; it was not yet final when announced.

In an action brought by Greenpeace France, Les Amis de la Terre and Notre Affaire à Tous, the Paris Judicial Court (Tribunal judiciaire de Paris, 34th chamber) found that TotalEnergies had advertised on totalenergies.fr with the goal of ‘carbon neutrality by 2050’ and its role as a player in the energy transition without disclosing that oil and gas production continues to be expanded – a misleading commercial practice. The court ordered the communication to cease, damages to be paid to the associations and the operative part of the judgment to be published on the website (RG 22/02955); claims relating to gas and agrofuels were dismissed.

The fines total 936,659,087 EUR: Eni 336,214,660, Kuwait Petroleum Italia 172,592,363, Italiana Petroli 163,669,804, Esso Italiana 129,363,561, Tamoil Italia 91,029,755 and Saras 43,788,944 EUR. Eni's basic amount was increased by 10–15% for its leading role in initiating and monitoring the coordination.
A competition compliance programme only reduces a fine if it is effectively implemented and demonstrated in good time, and public price information can itself sustain a cartel.

29 Aug 2025 Strom- und Gasversorger mit mindestens 75.000 Kunden (in der amtlichen Mitteilung anonymisiert)Bundesnetzagentur: energy supplier must reverse invalid price increases Order
Despite price guarantees it had given, an electricity and gas supplier tried at the end of July 2022 to impose unilateral price increases from 1 September 2022, often raising the unit price by several hundred per cent. The Bundesnetzagentur (Federal Network Agency) found that it had breached the information and transparency duties of Section 41(5) of the Energy Industry Act (EnWG), that the increases were therefore invalid and that from March 2023 it had nonetheless billed customers who had objected at the higher prices; it ordered all adjustments to be withdrawn and reversed within six months and threatened a penalty payment of 100,000 EUR. The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) upheld the decision on 13 August 2026 (not final).
Price guarantees apply even in an energy crisis; unilateral price rises need a sound legal basis and simple, understandable customer information.

26 Aug 2025 TerraCom LimitedTerraCom: AUD 7.5m penalty for victimising a whistleblower €4.18m
In 2020 the ASX-listed coal mining company used two ASX announcements and an open letter to shareholders to present as false the allegations of a former senior employee about coal quality certificates amended without proper justification, although an independent investigation at least partly supported them. On the basis of an admission and a jointly proposed penalty, the Court found a contravention of the prohibition on victimising whistleblowers and allegedly imposed AUD 7.5 million (payable in two instalments); TerraCom also pays AUD 1 million of ASIC’s costs. It is ASIC’s first enforcement outcome for breaches of the whistleblower protection provisions.

18 Aug 2025 LandsvirkjunIceland: Landsvirkjun fined 1.4 billion ISK for margin squeeze €9.79m
Samkeppniseftirlitið (Icelandic Competition Authority) found that the dominant electricity producer Landsvirkjun, from 2017 to 2021, in many cases bid lower in the tenders of grid operator Landsnet for transmission losses than the price at which it sold wholesale electricity to competitors, so that they could only keep up at a loss (margin squeeze). The authority classified this as an intentional abuse of a dominant position and imposed a fine of 1,400,000,000 ISK; aggravating factors were the long duration and the fact that the conduct increased after Landsvirkjun knew of the investigation.
A dominant company that also supplies its competitors must price its own offers so that these customers can still compete profitably on the downstream market.

26 Jun 2025 SIA "Mārupes komunālie pakalpojumi"Water utility Mārupes komunālie pakalpojumi abuses monopoly over additional meters €78,056
From January 2022, by internal instruction, the municipal water utility reserved to itself the installation of additional water meters (for example for garden water), thereby excluding other providers; customers also had to pay for sewerage they did not use. The Konkurences padome (Latvian Competition Council) found an abuse of a dominant position, imposed 78,055.79 EUR and ordered remedies.
Municipal utilities are also subject to competition law – internal instructions that foreclose neighbouring markets are risky.

20 Jun 2025 EquinorEquinor: Havtil order after health symptoms during work at Hammerfest LNG Order
Havindustritilsynet (Havtil, Norwegian Ocean Industry Authority) ordered Equinor to ensure and document that work in area L201 of the Hammerfest LNG plant is fully prudent before it resumes, including specialist analyses of exposure conditions at the work site. The order followed three incidents between June 2024 and June 2025 in the Snøhvit Future project in which workers developed symptoms – after the first, 17 people went to an emergency clinic; the authority considered Equinor's own criteria for resuming work to be insufficient.
After repeated health incidents, work should only resume once exposure conditions have been analysed by specialists and the findings are also applied by the contractors involved.

16 Jun 2025 Farringdon Energy Limited (Handelsname Champion Energy)Ofgem: GBP 214,580 fine for Farringdon Energy over direct debits without supply €251,766
Ofgem found that the business electricity supplier lacked robust, documented processes – they relied on the knowledge of a single employee – and therefore collected direct debits from customers it was not, or no longer, supplying; 25 customers suffered a detriment of around GBP 175,000. Following a provisional order in May 2024, the authority confirmed a penalty of GBP 223,676, from which it deducted GBP 9,096 in goodwill payments already made, leaving GBP 214,580 to pay.

10 Apr 2025 Acea Energia S.p.A.Garante: €3m fine for Acea Energia over aggressive telemarketing through agencies €3m
Joint investigations with the Guardia di Finanza showed that a network of agencies called people on behalf of Acea Energia who had recently switched energy supplier, pretending there were non-existent technical problems with the switch, and used data lists that had been passed on without consent and without prior information. The Garante (Italian data protection authority) fined Acea Energia 3,000,000 EUR because its control over processors and the sales chain was inadequate; the company must inform the data subjects and review the agencies' contracts with sub-agents. In a separate decision, fines totalling 850,000 EUR were imposed on the agencies and companies involved.

On appeal, the head of the authority dropped the e-mail allegation for procedural reasons, set aside the part concerning the failure to acknowledge a report and set the fine at 2,000 EUR solely for the missing information on reporting channels to the competent authorities (September 2023 to September 2024).

17 Mar 2025 Gaslieferant für Haushaltskunden (in der amtlichen Mitteilung anonymisiert)Bundesnetzagentur: conditions for gas supplier after cutting off 350,000 households Order
A gas supplier had stopped supplying around 350,000 household customers without notice in December 2021 and terminated the contracts retroactively. When it sought to resume business in 2023, the Bundesnetzagentur (Federal Network Agency) made this subject to conditions because of the management's continuing unreliability: only gradual customer growth until spring 2028, submission of audited annual accounts for 2023 to 2026 and notification of changes to procurement, tariffs and terms until the end of 2027, with penalty payments of up to 100,000 EUR for breaches. The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) dismissed the appeal on 23 July 2026; a further appeal on points of law has been allowed.
A supplier that abruptly cuts off household customers must expect years of conditions, as the reliability of its management remains under scrutiny.

During the HSR waiting period for the 1.4 billion USD acquisition of EP Energy, XCL and Verdun already took control of day-to-day operations: they halted drilling projects, managed customer contracts in Utah and coordinated prices in Texas (94 days). In a settlement filed by the DOJ on behalf of the FTC, the companies agreed to a civil penalty of 5.6 million USD – the highest ever for gun-jumping in the US; court approval under the Tunney Act was still pending at the time of publication.

7 Jan 2025 City of Boardman (Oregon)City of Boardman: 8,770 USD – water system's risk assessment was an empty template €8,438
The U.S. Environmental Protection Agency (EPA, Region 10) imposed a civil penalty of 8,770 USD by consent agreement and final order on the City of Boardman (Oregon), whose drinking water system serves around 4,490 people. According to the EPA, the city had not prepared the risk and resilience assessment and emergency response plan required by the Safe Drinking Water Act on time and had not complied with a 2022 EPA order: at an inspection in April 2024 the assessment was an empty template, and the emergency response plan dated from 2005 and contained no cybersecurity section. The city admitted jurisdiction without admitting or denying the factual allegations and waived its right to appeal. The authority allegedly made the findings set out here; this account is not based on a final judgment.
Mandatory assessments of physical and cyber security must be substantively prepared and kept up to date – a template that has merely been certified does not meet the obligation.

The court hearing the charge found that in April 2021, at a refinery in Ontario, steam from a steam-tracer leak that had been known since January and whose repair had been deferred bored into an adjacent line, releasing about 1,150 litres of slop oil. Neighbouring businesses and residents reported odours, irritation, headaches and nausea. The operator was convicted under the Environmental Protection Act of discharging a contaminant causing an adverse effect and fined CAD 900,000 plus a victim fine surcharge of CAD 225,000.

19 Jul 2024 a French energy groupCNIL reprimands energy group over employees' rights in an internal investigation Reprimand or warning
Following complaints from three employees, the President of the CNIL (French data protection authority) issued a French energy group with a reprimand (rappel à ses obligations légales under Art. 20 III of the Loi Informatique et Libertés, the French Data Protection Act). The employees were affected by an internal investigation following reports; the company had rejected their objection to the processing without sound reasons, informed them incompletely, refused access requests and answered one request late. On 1 December 2025 the Conseil d'État (French supreme administrative court) confirmed that the processing was based on legitimate interest rather than a legal obligation, so the right to object applied, and that access had to be given, with redactions where needed to protect third parties.
Employees keep their rights of access and objection even in internal investigations; third-party rights justify redactions, not a blanket refusal.

The consumer protection department of Senacon fined an electricity distributor 12,500,000.00 BRL because interruptions to the power supply and delayed restoration breached the requirements of the Consumer Protection Code on adequate public services. The decision was also communicated to the Ministry of Mines and Energy and the regulator ANEEL.

17 Jun 2024 a US trading company of an international commodity trading groupCommodity trader: 55 million USD for third-party inside information, benchmark manipulation, gagging NDAs €51.3m
From 2014 to April 2019 the US trading company of an international commodity trading group traded gasoline while in possession of confidential information that an employee of a Mexican trading entity had passed on in breach of his duties, and in February 2017 it artificially pushed up the USGC HSFO benchmark by buying 80 cargoes of fuel oil (3.6 million barrels) in the Platts trading window to benefit its own derivatives positions. In addition, broadly drafted confidentiality clauses in employment and separation agreements (2017–2020) hindered employees from contacting the CFTC (U.S. Commodity Futures Trading Commission) directly – according to the regulator, its first action of this kind against a company. Under a settlement, the trader pays a civil monetary penalty of 55,000,000 USD and must amend the clauses.
Confidentiality clauses need an express carve-out for reports to the authorities, and market information from other firms must be checked for its origin before trading on it.

The consumer protection department of Senacon fined an electricity distributor 13,067,441.04 BRL because interruptions to the power supply and delayed restoration amounted to an inadequate service in an essential public utility. It also invited the Ministry of Mines and Energy and the regulator ANEEL to consider administrative intervention or revocation of the concession; the Senacon Secretary rejected the appeal in November 2024. Shortly before, the authority had issued a decision for the same amount against another electricity distributor of the same group.
Utilities are liable under consumer law for lengthy outages; besides fines, they face scrutiny of consequences under their concession.

6 Jun 2024 an Italian energy supplierGarante: €6.4m fine for energy supplier over unlawful promotional calls €6.42m
After 108 reports and 7 complaints about unwanted promotional calls, the Garante (Italian data protection authority) found that calls were made for the energy supplier without consent or to numbers entered in the do-not-call register and that the company did not adequately control agencies and sub-agencies: in a sample week, 657 of 747 contracts stemmed from unlawful contacts. In addition to a fine of 6,419,631 EUR, the authority prohibited further processing of the complainants' data and ordered that the 657 data subjects be informed and that controls be introduced to keep contracts from unlawful contacts out of the systems.
Contracts arising from unlawful marketing contacts must not enter the system in the first place – audits and removing individual agents are not enough.

The Secretaria Nacional do Consumidor (Senacon, National Consumer Secretariat) fined an electricity distributor 13,067,441.04 BRL. 28 May 2024 a Scottish offshore wind farm companyOfgem: offshore wind farm pays GBP 33.14m over excessive constraint bids €39m
The operator of the offshore wind farm accepted that it had breached the Transmission Constraint Licence Condition by charging excessive prices in the balancing mechanism to reduce its output during grid constraints, thereby pushing up costs for consumers. Instead of a formal investigation, it paid GBP 33.14m into Ofgem's redress fund and changed its bid pricing policy; in its own view the breach was unintentional.
A generator facing little competition during grid constraints must not exploit this with excessive prices – and must review and document the compliance of its bids.

28 May 2024 a Japanese electricity utilityJapanese utility: surcharge for misleading claims of cheaper electricity tariffs €9.71m
From April 2022 to January 2023, the utility claimed on its website and in a brochure that two household tariffs of one of its tariff plans were cheaper than its standard tariff for households using up to, or more than, 400 kWh a month respectively. Because the fuel-cost adjustment in these tariffs turned out higher, this was not true in some cases; following a joint investigation with a regional office of the Japan Fair Trade Commission (JFTC, 公正取引委員会), a surcharge of 1,655,940,000 JPY was imposed (1,086,170,000 JPY for one tariff, 569,770,000 JPY for the other).
Tariff comparisons must also take variable price components such as fuel-cost adjustments into account; otherwise 'cheaper' becomes a misleading price claim.

13 Oct 2023 a Dutch offshore construction companyNetherlands: EUR 27,000 fine on an offshore construction company as project crew worked up to 27 days in a row €27,000
The Dutch Minister of Social Affairs and Employment fined a Dutch company whose activities include building and maintaining offshore wind farms EUR 27,000: according to the findings of the mining regulator Staatstoezicht op de Mijnen (Dutch State Supervision of Mines), twelve members of a project crew working on the construction of an offshore wind farm had worked on more than 14 consecutive days between 23 November and 20 December 2022; eleven of them for 20 days and one for 27 days in a row. The company argued without success that the working time rules for seafarers applied to the crew, which worked mainly on a crane vessel; the competent court dismissed its appeal on 20 November 2025.
For offshore work, the nature of the work determines which working time rules apply: anyone working for a wind farm is subject to the stricter offshore rules, even if the crew works mainly on board a ship.

28 Sep 2023 an Italian energy supplierGarante: €10m fine for energy supplier over energy contracts customers never ordered €10m
The energy supplier concluded electricity and gas contracts through a network of around 280 door-to-door sales agents without using alert systems, agency checks or accuracy checks to ensure that the data entered belonged to the actual users of the supply points; this led to unsolicited contracts with inaccurate or outdated data of more than 5,000 people. The Garante (Italian data protection authority) imposed a fine of 10,000,000 EUR, ordered technical and organisational remedial measures and definitively restricted further processing of the data of the customers concerned.
Contract data from field sales must be checked for accuracy and for the customer's genuine intention before activation.

20 Jul 2023 a Spanish power generatorCNMC: €6m fine on a Spanish power generator for price manipulation in balancing market €6m
The Comisión Nacional de los Mercados y la Competencia (CNMC, Spanish competition and markets authority) fined the power generator 6,000,000 EUR because between March 2019 and December 2020 one of its gas-fired plants submitted unjustifiably excessive bids in the technical constraints market that differed markedly from its own bids in the day-ahead market. In addition, the company must pay 35,500,000 EUR as compensation over 22 months to the system operator (Operador del Sistema) for the benefit of the demand side; this compensation is not a fine and is not included in the amount.
Bids in balancing and ancillary services markets must not differ markedly from the company's own bids in other market segments without objective justification; exploiting weak competition can be punished as price manipulation with compensation for the damage.
