5 Jun 2025 MAGEBA Gesellschaft m.b.H.; Maurer SE, Maurer Söhne Ges. mbH (nur Feststellung)Bridge component suppliers: €400,000 fine on MAGEBA, leniency applicant Maurer not fined €400,000
The Kartellgericht (Cartel Court) fined MAGEBA Gesellschaft m.b.H. 400,000 EUR because, from November 2017 to December 2018, it shared customers for road expansion joints and bridge bearings in Austria with a competitor and exchanged information on pricing behaviour. Against Maurer SE and Maurer Söhne Ges. mbH the court merely declared the infringement because of their leniency status. A compliance system introduced in the course of cooperation was taken into account in mitigation, and intent in a hardcore restriction as an aggravating factor.
The first to report a cartel can escape a fine entirely, while those who wait pay; this argues for internal reporting channels and quick decisions on a leniency application.
