28 May 2025 ABN AMRO Bank N.V.OM: €14m for ABN AMRO over aiding dividend tax evasion €14m
The Openbaar Ministerie (OM, Dutch Public Prosecution Service) imposed a penalty order (strafbeschikking) with a fine of 14 million EUR on ABN AMRO Bank N.V. as an out-of-court settlement. According to investigations by the FIOD (Fiscal Information and Investigation Service), the Dutch subsidiary of a foreign bank had offset a total of 124 million EUR in dividend tax in its corporate income tax returns for 2009 to 2013, although the shares were only parked in the Netherlands briefly around the dividend date; because share and derivative transactions with ABN AMRO or its legal predecessors formed part of this structure, the OM accuses the bank of aiding and abetting from mid-2010 to mid-2013. In setting the amount the OM took into account the gross revenues from the transactions, the bank’s cooperation and the age of the offences.
Banks should check securities and derivative transactions around dividend dates to see whether they enable counterparties to claim unjustified tax credits.
