From 26 April 2021 to 25 July 2023, Apple abused its dominant position in the distribution of apps on iOS and iPadOS devices by designing the App Tracking Transparency consent prompt for the use of data for advertising purposes in a discriminatory, non-objective and non-transparent way. In the view of the Autorité de la concurrence (French Competition Authority), the mechanism was neither necessary nor proportionate for protecting privacy: it multiplied the consent windows in third-party apps and disadvantaged small, advertising-funded providers in particular. In addition to the fine of EUR 150 million, Apple must publish a summary of the decision.
Privacy features of a dominant platform must be designed neutrally for its own and third-party offerings; otherwise they become open to challenge under competition law.
