5 Mar 2025 OTTO FUCHS Beteiligungen KGDüsseldorf Higher Regional Court: 30 million EUR on OTTO FUCHS for information exchange among forges GermanyCartels and collusion €30m

The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) fined OTTO FUCHS Beteiligungen KG 30 million EUR because two of its authorised officers had, twice a year from October 2010 to November 2015, exchanged information on cost and price components with other aluminium forges in the 'Aluminium Forging Group', for example on customers' discount demands and increased storage costs. The amount covers only the fine imposed on the company.

What organisations can take from it

Regular industry meetings on costs and discounts are risky even without price fixing, and management is personally liable if supervision is inadequate.

Mitigating circumstances
The exchange was often vague and concerned price components with a small share of costs, so the potential for profit and damage was low; negotiating pressure between aluminium suppliers and the automotive industry. Turnover related to the offence of more than 1 billion EUR and group turnover of around 3.4 billion EUR a year counted against the company.
