15 Jul 2026 CalPlus GmbH, Elektronik-Kontor Messtechnik GmbH, TVW Meßtechnik GmbHBundeskartellamt: 453,000 EUR against distributors of test and measuring equipment €453,000
From 2016 to 2022, three distributors of test and measuring equipment coordinated discounts as essential price components and informed each other of customer contacts, usually with a request for "restraint". This was evidenced by more than 400 emails; the proceedings ended in settlements.
Small distributors are liable too: merely asking a competitor to "hold back" with a customer is a prohibited customer allocation agreement.

19 Nov 2025 Pfanner Schutzbekleidung GmbH, Protos GmbH, Pronocer Holding GmbH (vormals Holding-AG der Gruppe)Pfanner: €400,000 fine for resale price maintenance in workwear trade €400,000
The Kartellgericht (Cartel Court) fined Pfanner Schutzbekleidung GmbH, Protos GmbH and their holding company (now Pronocer Holding GmbH) 400,000 EUR because, from 9 March 2016 to 25 November 2021, they fixed their dealers' resale prices for work and protective clothing in Austria. Compliance was monitored systematically, dealers who deviated were contacted, and in 2019 a circular reminded all dealers of the prices. Reductions were granted for the settlement, cooperation and a newly introduced compliance system.
Circulars urging dealers to keep to prices are direct evidence of resale price maintenance and should be legally reviewed before they are sent.

The Kartellgericht (Cartel Court) imposed a joint fine of EUR 3 million on an Austrian industrial goods manufacturer and its owning entity for a long-running infringement in the distribution of its own products in Austria between 2007 and 2021. Resale prices, a territorial split and non-compete obligations were agreed with authorised dealers, together with concerted practices such as cover bids. The companies acknowledged the infringement and received reductions for cooperation and settlement.
Distribution agreements must be checked for resale price maintenance, territorial protection and non-compete clauses before signature; cover bids by dealers at the manufacturer's request are also cartel infringements.

19 Feb 2024 an Austrian supplier of functional and protective clothingBundeskartellamt: €783,900 on protective clothing supplier for resale price maintenance €783,900
The Bundeskartellamt (Federal Cartel Office) fined the Austrian supplier of functional and protective clothing 783,900 EUR because, from early 2016 to the end of November 2021, it had agreed with specialist retailers in Germany that their resale prices – in store and online – should as far as possible match the recommended retail price and that cash discounts should generally not be granted. The case was triggered by a retailer's cooperation request; the authority used requests for information under Section 82b GWB (German Competition Act), and the fining decision is final following a settlement.
Manufacturers may only recommend prices to retailers; agreements designed to prevent discounts or prices below the recommended price attract fines.

2 Dec 2022 a Swiss services company of an electrical engineering groupSwiss Attorney General fines group company over bribery in South Africa €4.07m
From 2013 employees of an electrical engineering group set up a bribery scheme in which inflated payments to subcontractors were used to channel benefits to public officials in South Africa and win contracts for the construction of a coal-fired power station (bribes of at least CHF 1.3 million, contracts worth at least USD 200 million). By summary penalty order, the Bundesanwaltschaft (BA, Office of the Attorney General of Switzerland) convicted a Swiss services company of the group for failing to take all reasonable organisational measures to prevent this, fined it CHF 4,000,000 (statutory maximum CHF 5 million) and ordered it to pay procedural costs of CHF 50,000. The BA waived a compensatory claim because the group had already paid USD 104 million to South Africa in 2020.
Payments to subcontractors in high-risk countries must be checked for genuine consideration and reasonableness, or the company is liable for missing safeguards.
