14 Mar 2025 ING Bank N.V., Sucursal en EspañaAEPD: €1.6m fine for ING Spain over social security check when opening accounts €1.6m
ING made opening an account conditional on customers consenting to the retrieval of information on their economic activity from the social security treasury (TGSS), relying on anti-money laundering rules. The AEPD found that this procedure involved processing without a valid legal basis (Art. 6(1) GDPR); the sanction of 2,000,000 EUR was reduced to 1,600,000 EUR after voluntary payment without admission of liability, and remedial measures were also ordered.
Anyone relying on consent for queries to public authorities must obtain it freely and must not make opening an account conditional on it.
