17 Mar 2025 Gaslieferant für Haushaltskunden (in der amtlichen Mitteilung anonymisiert)Bundesnetzagentur: conditions for gas supplier after cutting off 350,000 households GermanyConsumer protection and online retail Order

A gas supplier had stopped supplying around 350,000 household customers without notice in December 2021 and terminated the contracts retroactively. When it sought to resume business in 2023, the Bundesnetzagentur (Federal Network Agency) made this subject to conditions because of the management's continuing unreliability: only gradual customer growth until spring 2028, submission of audited annual accounts for 2023 to 2026 and notification of changes to procurement, tariffs and terms until the end of 2027, with penalty payments of up to 100,000 EUR for breaches. The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) dismissed the appeal on 23 July 2026; a further appeal on points of law has been allowed.

What organisations can take from it

A supplier that abruptly cuts off household customers must expect years of conditions, as the reliability of its management remains under scrutiny.

The decisive factor was the unreliability of management; according to the court's findings it showed no insight and settled customers' losses only inadequately.
