10 Apr 2025 Acea Energia S.p.A.Garante: €3m fine for Acea Energia over aggressive telemarketing through agencies ItalyMarketing and consent €3m

Joint investigations with the Guardia di Finanza showed that a network of agencies called people on behalf of Acea Energia who had recently switched energy supplier, pretending there were non-existent technical problems with the switch, and used data lists that had been passed on without consent and without prior information. The Garante (Italian data protection authority) fined Acea Energia 3,000,000 EUR because its control over processors and the sales chain was inadequate; the company must inform the data subjects and review the agencies' contracts with sub-agents. In a separate decision, fines totalling 850,000 EUR were imposed on the agencies and companies involved.

What organisations can take from it

Principals are liable for the unlawful contact sourcing of their agencies if they do not verify sub-contracting and the origin of data lists.
