Pfizer pays USD 59,746,277 on behalf of its subsidiary Biohaven to resolve False Claims Act and Anti-Kickback Statute allegations relating to the period before the acquisition; about USD 50.2 million goes to the federal government and about USD 9.5 million to state Medicaid programmes. From March 2020 to September 2022 Biohaven allegedly gave selected doctors speaker fees and meals at expensive restaurants to encourage prescriptions of the migraine drug Nurtec ODT; some events were attended repeatedly by the same doctors or by spouses, relatives and practice colleagues with no educational need.
In acquisitions, the target's speaker programmes and payments to doctors belong in due diligence – the liability passes to the buyer.
