20 Jul 2026 Enforcesco, S.A.Portugal: €107,920 for Enforcesco over switches without consent and gas reserves €107,920
In a settlement procedure the energy regulator ordered electricity and gas supplier Enforcesco to pay 107,920 EUR in total: 90,000 EUR (halved from 180,000 EUR) under the energy-sector sanctions regime and 17,920 EUR in voluntarily paid fines for economic administrative offences. The breaches included taking over 6,853 customers without explicit consent, failing to hold the required natural gas security reserves from January 2023 to February 2025, incorrect invoices, an unlawful disconnection and a call-centre answer rate of only 57.8% in 2023.
Mass customer acquisitions without documented consent and neglected mandatory reserves reveal a lack of compliance oversight during growth.

3 Jun 2026 OVO Energy LimitedOfgem: OVO pays GBP 10.4m over poor support for vulnerable prepayment customers €12m
Ofgem found that OVO Energy did not adequately monitor prepayment customers in vulnerable situations, did not properly support customers who self-disconnected and did not maintain the Priority Services Register properly; some internal training materials were unclear and contradictory. By way of alternative action, OVO is paying GBP 7m into the voluntary redress fund and providing GBP 3.4m in credit and debt relief to its most vulnerable customers; under a separate compliance engagement it is also paying GBP 1.1m to customers in the Scottish Highlands and Islands.
Policies on paper are not enough: training materials and processes for vulnerable customers must be consistent and checked in practice.

23 Jan 2026 EDP Comercial – Comercialização de Energia, S.A.Portugal: €130,000 for EDP Comercial over disconnections and a banned clause €130,000
The energy regulator punished 13 offences by EDP Comercial with a combined fine of 260,000 EUR, halved to 130,000 EUR in the settlement procedure. The offences included supplier switches without explicit consent or without checking entitlement, unlawful disconnections and capacity reductions, missed call-centre response targets in 2023 and 2024, an absolutely prohibited standard contract clause and a marketing message that did not disclose its commercial purpose.
Contract clauses and marketing texts need a legal check before use, just as every disconnection does before it is carried out.

29 Aug 2025 Strom- und Gasversorger mit mindestens 75.000 Kunden (in der amtlichen Mitteilung anonymisiert)Bundesnetzagentur: energy supplier must reverse invalid price increases Order
Despite price guarantees it had given, an electricity and gas supplier tried at the end of July 2022 to impose unilateral price increases from 1 September 2022, often raising the unit price by several hundred per cent. The Bundesnetzagentur (Federal Network Agency) found that it had breached the information and transparency duties of Section 41(5) of the Energy Industry Act (EnWG), that the increases were therefore invalid and that from March 2023 it had nonetheless billed customers who had objected at the higher prices; it ordered all adjustments to be withdrawn and reversed within six months and threatened a penalty payment of 100,000 EUR. The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) upheld the decision on 13 August 2026 (not final).
Price guarantees apply even in an energy crisis; unilateral price rises need a sound legal basis and simple, understandable customer information.

20 Aug 2025 Petrogal, S.A.Portugal: €200,000 for Petrogal over deleted call recordings and more €200,000
The energy regulator imposed a combined fine of 400,000 EUR on electricity and gas supplier Petrogal, halved to 200,000 EUR in the settlement procedure. The trigger was an incident in 2023 in which an external service provider deleted all customer call recordings older than 30 days; further breaches were unpaid compensation, incorrect invoice data, deficient customer information, late replies to telephone enquiries and complaint-book entries that were not forwarded.
Retention obligations also apply to data held by service providers; external partners' deletion routines must be controlled contractually and technically.

16 Jun 2025 Farringdon Energy Limited (Handelsname Champion Energy)Ofgem: GBP 214,580 fine for Farringdon Energy over direct debits without supply €251,766
Ofgem found that the business electricity supplier lacked robust, documented processes – they relied on the knowledge of a single employee – and therefore collected direct debits from customers it was not, or no longer, supplying; 25 customers suffered a detriment of around GBP 175,000. Following a provisional order in May 2024, the authority confirmed a penalty of GBP 223,676, from which it deducted GBP 9,096 in goodwill payments already made, leaving GBP 214,580 to pay.

17 Mar 2025 Gaslieferant für Haushaltskunden (in der amtlichen Mitteilung anonymisiert)Bundesnetzagentur: conditions for gas supplier after cutting off 350,000 households Order
A gas supplier had stopped supplying around 350,000 household customers without notice in December 2021 and terminated the contracts retroactively. When it sought to resume business in 2023, the Bundesnetzagentur (Federal Network Agency) made this subject to conditions because of the management's continuing unreliability: only gradual customer growth until spring 2028, submission of audited annual accounts for 2023 to 2026 and notification of changes to procurement, tariffs and terms until the end of 2027, with penalty payments of up to 100,000 EUR for breaches. The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) dismissed the appeal on 23 July 2026; a further appeal on points of law has been allowed.
A supplier that abruptly cuts off household customers must expect years of conditions, as the reliability of its management remains under scrutiny.

28 May 2024 a Japanese electricity utilityJapanese utility: surcharge for misleading claims of cheaper electricity tariffs €9.71m
From April 2022 to January 2023, the utility claimed on its website and in a brochure that two household tariffs of one of its tariff plans were cheaper than its standard tariff for households using up to, or more than, 400 kWh a month respectively. Because the fuel-cost adjustment in these tariffs turned out higher, this was not true in some cases; following a joint investigation with a regional office of the Japan Fair Trade Commission (JFTC, 公正取引委員会), a surcharge of 1,655,940,000 JPY was imposed (1,086,170,000 JPY for one tariff, 569,770,000 JPY for the other).
Tariff comparisons must also take variable price components such as fuel-cost adjustments into account; otherwise 'cheaper' becomes a misleading price claim.

Telesales staff of the intermediary concealed the purpose of their calls when selling energy contracts and posed, for example, as the grid operator or the existing supplier. The ACM (Autoriteit Consument & Markt, Dutch competition and consumer authority) imposed a fine of 400,000 EUR on the company; on 19 June 2025 the Rechtbank Rotterdam (Rotterdam District Court) upheld the infringements but, because of the excessive length of proceedings, reduced the fine to 395,000 EUR. The amount covers only the fine imposed on the company.
Anyone running or commissioning telephone sales must design call scripts and spot checks so that callers always identify themselves openly as sellers.
