28 Aug 2026 MSC Shipmanagement Limited; Hong Kong Spirit Shipping and Trading LimitedMSC Shipmanagement: 1.75 million USD fine for secretly discharging oily bilge water €1.5m
On board the MSC Samira III, oily bilge water was pumped overboard via the sewage tank, bypassing the oily water separator, in 2024/2025; the oil content monitoring was manipulated and the oil record book, which was presented to the Coast Guard in Philadelphia, was falsified. The operator and the owner each pleaded guilty to two counts under the Act to Prevent Pollution from Ships (APPS) and are paying a combined 1.75 million USD; in addition, there are four years of probation.
Shipping companies must actively monitor practice on board and the oil record book, because instructions given by individual officers are attributed to the company under criminal law.

4 Dec 2025 Eurowings GmbHDüsseldorf Higher Regional Court bans misleading Eurowings CO2 offsetting claims Order
On appeal by the Verbraucherzentrale Bundesverband (Federation of German Consumer Organisations), the Oberlandesgericht Düsseldorf (Düsseldorf Higher Regional Court) prohibited Eurowings from advertising a €9 CO2 offset during online booking in a way that makes customers believe they travel climate-neutrally; it was not mentioned that other climate-damaging emissions are not offset. By contrast, the court did not consider the 'Sustainable Aviation Fuel' advertising misleading; it did not grant leave to appeal on points of law.
Anyone selling CO2 offsets must point out that only part of the climate impact is offset, even if each individual statement is correct.

6 Nov 2025 Braathens International Airways ABBraathens International Airways: SEK 142.8m for emission allowances not surrendered €13m
The Naturvårdsverket (Swedish Environmental Protection Agency) imposed a penalty of 142,757,565 SEK on the airline Braathens International Airways because it had not surrendered emission allowances for 99,707 tonnes of CO2 equivalent from 2024 by the deadline of 30 September 2025. The inflation-adjusted penalty amounts to 129.69 EUR per tonne (12,930,939 EUR) and does not release the company from the obligation to surrender allowances; the company had been declared bankrupt on 30 September 2025. A separate penalty was imposed on its sister company Braathens Regional Airways AB.
Surrendering emission allowances is a hard deadline without exceptions; even in a crisis it must be secured in liquidity planning.

27 Aug 2025 V.Ships Norway A.S.V.Ships Norway: 2 million USD fine for oil pollution and falsified oil record books €1.73m
On board the tanker M/T Swift Winchester, a hose connected the incinerator's waste oil tank to the sewage tank from February to August 2022, so that oily waste bypassed the pollution prevention equipment and went into the sea; in August 2022, an oily water separator filter was also hosed down with degreaser on deck and the oily mixture ran overboard. The vessel called at Baton Rouge and Port Arthur with a knowingly falsified oil record book. The ship management company pleaded guilty and is paying a fine of 2 million USD.
When a crew member reports misconduct to management, the company must intervene immediately; otherwise it is liable for the continued pollution.

28 Jul 2025 East Midlands Airport LtdEast Midlands Airport: £892,500 fine over de-icing fluid in drainage water €1.03m
Derby Crown Court imposed three fines of £297,500 each (£892,500 in total) and £65,687.54 in costs on the operator of East Midlands Airport. In January and February 2022, surface water drainage containing residues of aircraft and runway de-icing fluid exceeded the permitted BOD limit of 15 mg/l on three occasions. The court heard that there had already been 13 permit breaches and ten written warnings since 2006.
Repeated limit breaches despite earlier warnings push the level of the penalty up significantly.

21 Jan 2025 General Logistics Systems B.V., General Logistics Systems Italy S.p.A., General Logistics Systems Enterprise S.r.l. (GLS)GLS: €8m fine over misleading “Climate Protect” climate programme €8m
The AGCM (Autorità Garante della Concorrenza e del Mercato, Italian competition and consumer authority) fined General Logistics Systems B.V., General Logistics Systems Italy S.p.A. and General Logistics Systems Enterprise S.r.l. EUR 8,000,000 jointly and severally because the “Climate Protect” environmental programme was promoted with vague, unsubstantiated environmental claims and misleading certificates of offset CO2 emissions. Subscription customers, including micro-enterprises, also had to pay an unrequested climate contribution that clearly exceeded the programme's costs, while large customers were exempted. The authority classified this as an unfair commercial practice under Art. 20, 21, 22 and 26(f) of the Codice del consumo (Italian Consumer Code) and prohibited its continuation.
Climate contributions and offsetting promises must be voluntary, transparently calculated and verifiable; passing the costs of an environmental programme on to customers while using it for self-promotion risks greenwashing proceedings.

10 Jun 2024 a Norwegian ship management companyNorwegian ship management company: NOK 8m for scrapping two tankers in India €694,927
Økokrim (Norwegian National Authority for Investigation and Prosecution of Economic and Environmental Crime) issued a Norwegian ship management company with a penalty notice of NOK 8,000,000 for breaching the Pollution Control Act (forurensningsloven), because two shuttle tankers used in the North Sea left for Asia in 2018 and were broken up on the beach at Alang, India, between 2018 and 2020 ('beaching'). According to Økokrim, the company was familiar with the rules and chose scrapping in India partly for economic reasons. Having initially not accepted the penalty notice, the company accepted it before the main hearing scheduled for January 2025 without admitting guilt; an accepted penalty notice has the effect of a judgment.
Anyone handing over end-of-life vessels for scrapping must ensure recycling at approved yards in line with EU rules; the cost advantages of beaching do not justify circumventing them.

20 Mar 2024 a Dutch airlineAmsterdam District Court: airline advertising on sustainable flying misleading Other
In a collective action brought by a foundation, the Amsterdam District Court (Rechtbank Amsterdam) found that 15 of the airline's advertising claims were misleading and unlawful: they suggested sustainable flying or that offsetting products actually compensate for the climate impact, although biofuels and reforestation reduce it only marginally. The airline bears the costs of the proceedings; further claims were dismissed.
Offsetting and SAF offerings must not create the impression of climate-neutral travel; associations can challenge such claims in court.
