On a total of 249 days, the Portuguese branch of the energy supplier failed to hold the mandatory natural gas security reserves, did not correctly show network charges on invoices, did not publish, or published late, mandatory information and its quality report, and failed to meet the standards for hotline waiting times. In a settlement procedure, the Entidade Reguladora dos Serviços Energéticos (Portuguese Energy Services Regulatory Authority, ERSE) set a fine of 44,000 EUR and reduced it to 22,000 EUR.

What organisations can take from it

Security of supply and service obligations in the energy sector are sanctioned individually – a compliance calendar for reserves and reports helps.

15 Sep 2026 Ministerstvo životního prostředí (Umweltministerium der Tschechischen Republik)Ministry of the Environment: 300,000 CZK over unresolved conflict of interest of an insurance broker CzechiaOther €12,350

In an insurance tender in 2024 worth around 200 million CZK, the ministry had parts of the tender documents drawn up by a broker who could later receive commissions from the winning insurer. As the contracting authority took no measures against the conflict of interest, the Úřad pro ochranu hospodářské soutěže (Czech Office for the Protection of Competition, ÚOHS) imposed a final fine of 300,000 CZK.

What organisations can take from it

External advisers who help draft tender documents must not benefit from the outcome – examine and document conflicts of interest before the tender.

24 Jul 2026 Société d'exploitation d'un service d'information (SESI)Arcom: EUR 200,000 fine on CNews operator SESI over programme breaches FranceOther €200,000

On 24 July 2026 Arcom imposed a fine of EUR 200,000 on Société d'exploitation d'un service d'information (SESI), the operator of the news channel CNews. In Arcom's view, two programmes broadcast in June and September 2025 contained statements about people of (presumed) immigrant background and Muslims, without sufficient context or challenge, that were capable of inciting hatred and discrimination; Arcom considered this a breach of Article 15 of Law No 86-1067 and of the channel's contractual obligations on non-discrimination and control of its programming. In setting the amount, Arcom took into account earlier sanctions against SESI for breaches of the same obligations in 2021 and 2024. Arcom did not sanction a third programme it examined. Whether the decision has been appealed is not known here.

What organisations can take from it

Broadcasters of opinion formats must put polarising statements into editorial context; a lack of challenge in the studio reflects on the broadcaster.

10 Apr 2026 Koninklijke PostNL B.V.ACM: €6.9m fine for PostNL over late letter delivery in 2023 NetherlandsOther €6.92m

In 2023 PostNL delivered only 89.48% of letters with a five-day delivery obligation under the universal postal service on time, instead of the statutory 95%. The ACM (Autoriteit Consument & Markt, Dutch competition and consumer authority) rejected the force majeure argument based on the tight labour market and imposed a fine of 6,923,000 EUR.

What organisations can take from it

A company bearing a statutory service obligation must compensate for foreseeable staff shortages in good time; labour market conditions alone are not force majeure.

8 Jan 2026 HSBC Bank plcPNF: HSBC Bank plc pays €267.53m over dividend arbitrage (tax fraud) FranceOther €267.5m

HSBC Bank plc concluded a CJIP (convention judiciaire d'intérêt public, French deferred prosecution agreement) with the Parquet national financier (PNF, French national financial prosecutor) concerning intra-group dividend arbitrage trading structures run through its Paris branch between 2014 and 2019, which avoided withholding tax on dividends and may be classified as aggravated tax fraud. The bank pays a public interest fine of 267,531,000 EUR; for 2019 it had already paid 34,464,424 EUR in taxes, interest and penalties. Validated on 8 January 2026.

28 May 2025 ABN AMRO Bank N.V.OM: €14m for ABN AMRO over aiding dividend tax evasion NetherlandsOther €14m

The Openbaar Ministerie (OM, Dutch Public Prosecution Service) imposed a penalty order (strafbeschikking) with a fine of 14 million EUR on ABN AMRO Bank N.V. as an out-of-court settlement. According to investigations by the FIOD (Fiscal Information and Investigation Service), the Dutch subsidiary of a foreign bank had offset a total of 124 million EUR in dividend tax in its corporate income tax returns for 2009 to 2013, although the shares were only parked in the Netherlands briefly around the dividend date; because share and derivative transactions with ABN AMRO or its legal predecessors formed part of this structure, the OM accuses the bank of aiding and abetting from mid-2010 to mid-2013. In setting the amount the OM took into account the gross revenues from the transactions, the bank’s cooperation and the age of the offences.

What organisations can take from it

Banks should check securities and derivative transactions around dividend dates to see whether they enable counterparties to claim unjustified tax credits.

16 Apr 2025 Il Sole 24 Ore S.p.A. (Radio 24)AGCOM: €150,000 fine for Il Sole 24 Ore over hate speech on a Radio 24 programme ItalyOther €150,000

On the radio programme "La Zanzara" of 28 November 2024, a guest made statements about Muslims that AGCOM (Italian communications regulator) considered capable of spreading hatred and discrimination against a group of people; the presenters had not effectively prevented their impact. The authority fined the broadcaster five times the minimum amount, 150,000 EUR; in its view, the later distancing in a subsequent programme and the deletion of the segments from 13 December 2024 only partly mitigated the infringement and did not reduce the sanction.

What organisations can take from it

Broadcasters must moderate live formats so that inflammatory statements by guests are immediately put into context and not further disseminated.

20 Jul 2023 a Spanish power generatorCNMC: €6m fine on a Spanish power generator for price manipulation in balancing market SpainOtheranonymised €6m

The Comisión Nacional de los Mercados y la Competencia (CNMC, Spanish competition and markets authority) fined the power generator 6,000,000 EUR because between March 2019 and December 2020 one of its gas-fired plants submitted unjustifiably excessive bids in the technical constraints market that differed markedly from its own bids in the day-ahead market. In addition, the company must pay 35,500,000 EUR as compensation over 22 months to the system operator (Operador del Sistema) for the benefit of the demand side; this compensation is not a fine and is not included in the amount.

What organisations can take from it

Bids in balancing and ancillary services markets must not differ markedly from the company's own bids in other market segments without objective justification; exploiting weak competition can be punished as price manipulation with compensation for the damage.

9 Feb 2023 a French television channelArcom: EUR 3.5 million fine on a TV channel over a live broadcast FranceOtheranonymised €3.5m

Arcom (French audiovisual and digital communications regulator) fined a French television channel EUR 3,500,000 (3.65% of its 2021 turnover) because, in a programme of 10 November 2022, the presenter insulted an invited member of parliament for more than nine minutes without anyone in the studio stepping in to calm things down. This breached the obligations under the agreement with the regulator to protect personality rights and to keep control of the programme; the channel had already been sanctioned for similar breaches in 2017 and 2019. The Conseil d'État (French supreme administrative court) dismissed the appeal on 10 July 2024.

What organisations can take from it

Broadcasters are liable for their presenters' live statements; effective ways of intervening during a programme are part of compliance.
