9 Feb 2023 a Brazilian carmakerBrazilian carmaker: BRL 22.4m over misused cultural sponsorship funding BrazilBribery and corruptionanonymised €3.99m

The Controladoria-Geral da União (CGU, Office of the Comptroller General) set a fine of BRL 22,423,482.15 against a carmaker in an early resolution procedure (julgamento antecipado) under the cultural incentive law (Lei nº 8.313/1991) and the Anti-Corruption Law. The carmaker had sponsored with BRL 1,000,000 a concert project funded through the National Culture Support Programme (Pronac), which was turned, without the consent of the Ministry of Culture, into a corporate party for the company's 60th anniversary that was not open to the public; according to the final report, false information was given in the project accounts. A separate decision issued the same day fined the project's proponent BRL 2,940,317.28.

What organisations can take from it

Sponsorship backed by state tax incentives must serve exactly the approved project purpose; redirecting it to the company's own corporate events can be sanctioned as an offence by the sponsor itself.
