The AGCM found that Apple's App Tracking Transparency (ATT) policy, in force since 26 April 2021, constituted an exploitative abuse of a dominant position: third-party iOS app developers had to use Apple's ATT prompt in addition to their own consent request for the same purpose, a condition imposed unilaterally and disproportionately. Apple Inc., Apple Distribution International Ltd and Apple Italia S.r.l. were fined 98,635,416.67 EUR and ordered to end the conduct immediately; the authority expressly did not question Apple's aim of protecting privacy.
