31 Dec 2025 C2MAC Group, Fonderie De Riccardis, Zanardi Fonderie u. a. (Gießereikartell, 12 Unternehmen und Assofond)Italy: 70 million EUR against 16 foundries and the association Assofond over price index cartel ItalyCartels and collusion €70m

From 2004 to June 2024, foundries coordinated their pricing strategies via the association Assofond: they exchanged sensitive information and developed joint indexation mechanisms ("Assofond indicators") in order to push through price increases including margins. The AGCM imposed fines of 70 million EUR (maximum around 600 million EUR), taking the crisis in the sector into account as a mitigating factor. Addressees: C2MAC Group, Fonderia Corrà, Fonderie De Riccardis, Fonderie Guido Glisenti/Lead Time, Pilenga Baldassarre/E.F. Group, Fonderie Mora Gavardo/Camozzi Group, Zanardi Fonderie, VDP Fonderia, Fonderie Ariotti, Ironcastings, Fonderia Zardo, ZML Industries/Cividale, Assofond.

What organisations can take from it

Joint price indices within an association are only permissible if they do not enable coordination of margins or prices – metalworking companies should have their association activities accompanied by competition law advice.

10 Dec 2025 Lech-Stahlwerke GmbHDüsseldorf Higher Regional Court: 21 million EUR fine on Lech-Stahlwerke for price fixing GermanyCartels and collusion €21m

The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) fined Lech-Stahlwerke GmbH 21 million EUR for unlawful price fixing and the exchange of competitively sensitive information. This followed a negotiated agreement setting a fine range of 20 to 30 million EUR, after which the company limited its objection against the Bundeskartellamt's (Federal Cartel Office) fining decision of 27 January 2021 to the penalty; the proceedings against BGH Edelstahlwerke GmbH continue separately.

What organisations can take from it

An objection to a cartel fine can end years later in a court-imposed fine running into millions; a negotiated agreement brings predictability, not acquittal.

5 Mar 2025 OTTO FUCHS Beteiligungen KGDüsseldorf Higher Regional Court: 30 million EUR on OTTO FUCHS for information exchange among forges GermanyCartels and collusion €30m

The Oberlandesgericht Düsseldorf (Higher Regional Court of Düsseldorf) fined OTTO FUCHS Beteiligungen KG 30 million EUR because two of its authorised officers had, twice a year from October 2010 to November 2015, exchanged information on cost and price components with other aluminium forges in the 'Aluminium Forging Group', for example on customers' discount demands and increased storage costs. The amount covers only the fine imposed on the company.

What organisations can take from it

Regular industry meetings on costs and discounts are risky even without price fixing, and management is personally liable if supervision is inadequate.

Relevance to training and awareness

The exchange was often vague and concerned price components with a small share of costs, so the potential for profit and damage was low; negotiating pressure between aluminium suppliers and the automotive industry. Turnover related to the offence of more than 1 billion EUR and group turnover of around 3.4 billion EUR a year counted against the company.
