The Autorité de la concurrence (French Competition Authority) sanctioned ten manufacturers of large and small appliances and the retailers Darty and Boulanger because, in twelve vertical agreements running between February 2007 and December 2014, each of them had fixed retail prices with its trading partners. Fines: SEB 189.5 million, Darty 109 million, Boulanger 84.35 million, BSH 54 million, Electrolux 44.5 million, Whirlpool 44.5 million and, as successor to Indesit, 27.75 million, Candy Hoover 22.75 million, LG 15.5 million, Miele 14.25 million, Smeg 4.8 million and Eberhardt 0.1 million EUR. The authority dropped the allegation of a data exchange via the trade association GIFAM.

What organisations can take from it

Recommended prices become prohibited resale price maintenance as soon as manufacturers and retailers jointly monitor and enforce compliance with them.
