The CNIL (French data protection authority) fined Solocal Marketing Services, a subsidiary of the Solocal group, EUR 900,000 and ordered it, subject to a penalty payment of EUR 10,000 per day, to stop electronic marketing without valid consent. On behalf of advertisers, the company had sent SMS and e-mail marketing to contacts that data brokers had obtained through misleadingly designed prize-draw and product-testing forms, and it could not provide proof of consent for one main supplier (Art. L. 34-5 CPCE, the French Post and Electronic Communications Code; Art. 7 GDPR). The company has challenged the sanction before the Conseil d'État (French supreme administrative court).

What organisations can take from it

Anyone using acquired contact data for marketing must effectively check the consent obtained by the supplier and be able to prove it; contractual assurances are not enough.
