The Openbaar Ministerie (OM, Dutch Public Prosecution Service) imposed a penalty order of 50,000 EUR on the supermarket chain Jumbo for breaching Art. 32 of the Arbeidsomstandighedenwet (Dutch Working Conditions Act) after an employee was fatally struck by one of the company’s reversing lorries at the distribution centre in Woerden on 20 October 2021. According to the investigation by the Nederlandse Arbeidsinspectie (Netherlands Labour Authority), the designated smoking area was next to the loading docks and lorry traffic without adequate separation, and the lorry’s reversing alarm had been switched off. Jumbo has redesigned the smoking area, had reversing alarms activate automatically at every start, cooperated and is additionally paying a sum to the bereaved family.
