27 Sep 2023 an Australian car repair garageAustralian car repair garage: 115,000 AUD after fatal crash following 89 hours on call €69,524
The garage, which ran a roadside assistance service as a subcontractor of a motoring club, was fined 115,000 AUD by the County Court in Melbourne after a guilty plea for failing to provide a safe system of work and information or training to protect against fatigue. Both of its breakdown assistance drivers regularly spent 96 hours on call across four days and nights; in March 2018 one of them left the road and died after 89 hours on call and 17 hours of work, and traces at the scene suggested that he had fallen asleep while driving.
On-call duty must be limited by maximum shift lengths and minimum breaks so that employees can rest adequately between call-outs.
Fatigue from long on-call periods and working hours
Missing or inadequate training played a role in the decision.
